Terms of Service

These Terms of Service govern your use of the Feelody waitlist at feelody.ai, operated by The Simple App Inc. ('Feelody', 'we', 'us'). By submitting your email address, you agree to these terms.

The Feelody app and its full terms of service — covering subscriptions, song creation, gifts, and content — will be published before the App Store launch. These terms cover the waitlist period only.

Joining the waitlist reserves your place in line for early access. It is not a purchase, a subscription, or a guarantee of access by any specific date.

Position on the waitlist is determined by the order in which email addresses are confirmed (via the double-opt-in link in the confirmation email) and by the number of verified referrals you generate. A referral is verified when the person you invited confirms their own email address using your referral code or link.

We reserve the right to remove waitlist entries that appear to be generated by bots, scripts, or other automated means, or that violate these terms.

Founding membership is earned by being among the first 1,000 waitlist members to generate three or more verified referrals.

The founding membership benefit is: 20% off Feelody's prevailing annual price — for life. 'Prevailing annual price' means the standard annual subscription price in effect at the time of each renewal. The 20% discount applies to each renewal for as long as the founding membership subscription remains active and in good standing.

No dollar amount is specified or guaranteed because the annual price may be adjusted before or after launch. The discount rate of 20% is the binding commitment, not any specific dollar figure.

Founding membership will be delivered as a StoreKit subscription offer code, emailed to the confirmed waitlist address when the app launches. Offer codes are non-transferable and may only be redeemed once. We are not responsible for offer codes that cannot be delivered due to an invalid, changed, or inaccessible email address.

If the Feelody app does not launch within 24 months of the date these terms were last updated, founding membership commitments will lapse with no obligation on either side.

The waitlist collects only your email address. There is no user-generated content at this stage.

You agree not to submit email addresses that belong to others without their consent, and not to use automated tools to generate waitlist entries or referrals.

The waitlist and this site are provided 'as is.' We make no warranty that the service will be uninterrupted or error-free. We make no commitment to any specific launch date, feature set, or pricing beyond what is stated in these terms.

To the maximum extent permitted by applicable law, The Simple App Inc. is not liable for any indirect, incidental, or consequential damages arising from your use of the waitlist. Our total liability for any claim related to the waitlist is limited to zero dollars, since no consideration has been exchanged.

These terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any dispute arising from these terms will be resolved in the courts of San Francisco County, California.

We may update these terms. Material changes will be communicated by email to waitlist members before they take effect. Your continued participation in the waitlist after the effective date constitutes acceptance of the revised terms.
